ICAO has agreed to review Venezuela's claim against Argentina regarding the Emtrasur B747 freighter Seizure.

The Bolivarian Republic of Venezuela claims that, since 8 June 2022, the Argentine Republic has committed violations by applying illegal unilateral restrictive measures of a discriminatory nature against Venezuela, as per the complaint.

 

Latin American terrestrial and satellite news television network Telesur says that the Secretary General of the International Civil Aviation Organization (ICAO), Juan Carlos Salazar Gómez, accepted the complaint filed by Venezuela against Argentina for serious violations of international law in order for the United States Government to carry out the theft and subsequent scrapping of an aircraft that legitimately belonged to the Venezuelan people.


 

The Bolivarian Republic of Venezuela filed a complaint with the International Civil Aviation Organization (ICAO) against the Argentine Republic. The claim is brought under Article 84 of the Convention on International Civil Aviation, its Annexes and the ICAO Dispute Settlement Rules.

 

In the complaint, the Bolivarian Republic of Venezuela asserts that, since 8 June 2022, the Argentine Republic has committed violations by applying illegal unilateral restrictive measures of a discriminatory nature against Venezuela.

 

Earlier to this, the Argentinian and US governments had gone to the International Civil Aviation Organization (ICAO) and made a claim against Venezuela’s Nicolás Maduro-led government after it closed Venezuelan airspace for Argentinian aircraft.

 

Worth noting, Last month, Argentina began diplomatic actions against Venezuela, for prohibiting the use of airspace. Argentine Presidential spokesperson said,

 "Argentina is not going to allow itself to be extorted by friends of terrorism."

 
 

As per Radiogovea, In a communication sent to the members of the ICAO Council, it was stated that the lawsuit was filed under Article 84 of the Convention on International Civil Aviation, known as the Chicago Convention, its Annexes and the Regulations for the Settlement of Disputes of the ICAO. ICAO. Its alos being asserted that "it conforms in form to the requirements of Article 2 of the Regulation."

 

It stated that "the Bolivarian Republic of Venezuela (the plaintiff) affirms that, since June 8, 2022, the Argentine Republic (the defendant) has committed violations of several articles of the Chicago Convention (namely: articles 3 bis, 4, 12, 13, 15, 16, 22, 27, 28, 32, 33, 44 and 82).
