Lawyer Shagatayev, who represented Zere and her mother, said that Air Astana had asked the court to reduce the moral compensation from 5 million tenge to 1.5 million tenge.
The appeals board of the Almaty City Court refused to satisfy the appeal and left the decision of the first court unchanged. This means that the child's mother will receive moral compensation in the amount of 5 million tenge, says Shagataev.
Now, according to the court's final verdict, the company must pay five million tenge as material compensation to Zere's mother.
It is also reported that earlier the Specialized Interdistrict Court for Administrative Offenses of Almaty imposed a fine on the airline in the amount of more than 3 million tenge under Part 2 of Article 567 of the Code of Administrative Offenses .
It is noted that on July 20 last year, twelve-year-old twin girls Zere and Zaure Galiyeva were returning from the United States to Uralsk with a stopover in Astana. According to the plan, she and her twin sister were supposed to fly to their place of residence to their parents.
However, during the check-in for the flight, employees of the FlyArystan airline (a subsidiary of Air Astana) registered only one of the sisters.
As a result, Zere, who was left without a boarding pass, was not allowed on the plane. FlyArystan employees, who promised to resolve the issue, left the child alone at the Astana airport.
"As the ground service worker testified in court, FlyArystan replaced the plane with a capacity of 188 seats with a plane with 180 seats."
"As a result, Zere became the 181st and only passenger who was unable to board the plane. Those passengers who had previously been unable to board the flights of the 19th and 20th were placed on Zere's plane. As a result, the minor passenger actually gave up his seat to other adult passengers who had also been unable to board the flights of the 19th and 20th," the lawyer said at the time.
After being denied boarding, the stranded girl Zere was able to fly to Uralsk unaccompanied by adults only the next day.
According to FlyArystan representatives, they had to change the plane to a less spacious one, so the company could not provide a seat on the plane for the girl.
"Airline agents asked passengers to give up their seats to Zere and offered compensation. Unfortunately, there was no volunteer among the passengers," the company reported at the time.
At a later stage, the press service of the Civil Aviation Committee also responded. It became known then that the KGA was planning to hold the airline administratively liable for not allowing a minor passenger on the flight.
On September 26, 2024, the family's lawyer reported that the State Civil Aviation Committee had drawn up a report against Air Astana and sent the materials to the administrative court.
As a result, the company was brought to administrative responsibility under Part 2 of Article 567 of the Code of Administrative Offenses and was fined 1,000 MCI (about 3,692,000 tenge).
During the court's consideration of the appeal, Air Astana representatives admitted their guilt, but asked the girl's mother to reduce the compensation for moral damage from 5 million tenge (about 10.5 thousand dollars) to 1.5 million.The court has rejected the airline's request.
